Status: Interest list only. Enrollment and credit applications are closed. What this means

Your agreement

Every term in writing, before you apply for anything

This is an outline of the proposed agreement set, in plain words. Drafts are with our attorneys and may change. The signed documents control, and you get time and your own attorney before you sign.

Draft, under counsel review

Status. Interest list only. Enrollment and credit applications are closed. The proposed program is under legal review and may change or may not launch.

Who is who

The borrower is a business owned by BCP, one LLC per partner. You apply on its behalf in your actual officer capacity and personally guarantee its debt. Each lender's documents identify the borrower and your obligations. Everyone on every form is who they say they are.

  • You, the credit partner

An officer of the borrower business, for example Vice President, Finance, appointed in writing before any application. You apply on the business's behalf in that actual officer capacity and personally guarantee its debt. You are a signer on its operating and reserve accounts.

  • The borrower business

One LLC per partner, owned by BCP, with a real business: the investments and secured real-estate loans set in the agreement. It is the borrower on every account, and each lender's documents identify it and your obligations. Under our agreement it is responsible for making payments and paying your fee.

  • BCP's holding companies

Own and manage the borrower, provide its capital, fund the reserve and give you the indemnity. They are listed truthfully wherever a form asks for owners or the person in control. Your agreement names each company, who owns it, its address, who receives funds, who owes your fee and who gives the indemnity.

  • Real-estate loans and licensing

Each proposed loan requires review of applicable licensing, interest-rate and other lending requirements. A broker's involvement alone does not establish compliance.

Your officer role

The role is real: you perform its duties, you hold its authority, and the forms say exactly what you are. It is not a title on paper.

Duties

  • Approve each application, any draw above a set amount and each use of the money.
  • Review the monthly statement package and act on alerts.
  • Respond with our team to any issuer review, with true documents only.
  • Keep a record of the duties you perform.

Authority

  • Refuse any application, draw or use of funds.
  • Stop new borrowing at any time by written notice.
  • Direct the reserve to pay an issuer if a payment is missed.
  • See every account with your own issuer login and the business's bank records.

Resignation and removal

  • You can resign as officer with 60 days' notice.
  • BCP can remove you as officer only on the terms in the agreement, with written notice.
  • Leaving the role, by resignation or removal, does not release a personal guarantee.
  • A guarantee ends only when each lender releases it in writing, or the debt is paid and the account closed.

As an officer you also owe the business duties of care and honesty, and you sign certifications to lenders. Ask your own attorney about any other liability an officer role can carry.

Each application

You control every application. Nothing is filed for you, and one approval never covers the next.

  1. 01

    You review it in full

Every field and every certification, before anything is sent.

  2. 02

You submit it with your own authorization

On your own device, and you separately authorize any credit inquiry it causes. We never hold your passwords or one-time codes.

  3. 03

    You keep a copy

A copy of what you submitted goes to you, and the same copy sits in your portal documents.

  4. 04

    No blanket authority

Approving one application never approves a future one. Each application needs your separate consent.

  5. 05

    Truthful answers only

Ownership, control, revenue, business age and use of funds are stated truthfully. If anything is untrue or unclear, you do not submit it.

Each application can add a hard inquiry to your credit reports.

Your fee

Your pay is set in a fee schedule you sign before any application.

Your fee

If the program launches, partners would be paid a fee set in your written agreement, signed before any application. When it is earned, and any caps, conditions or reversals, are set in that agreement. Payment is not assured.

How any fee works

  • Set in writing before any application.
  • Paid by the business from its own funds, on the schedule in your agreement.
  • Never paid from card cash advances or from the new credit itself.
  • Not a share of profits. It does not change with how the business's investments perform.
  • When it is earned, and any caps, conditions or reversals, are set in your written agreement.
  • You give a W-9 at signing. Our tax adviser sets how the fee is reported.

Costs and who pays

BCP charges no enrollment fee. Any third-party subscription, legal cost or other expense is disclosed before you incur it, along with who pays it.

Each cost you could face, who pays it and when you learn about it

Business costs: forming the borrower, its accounts, card fees, interest and the reserveThe business or BCP under our agreement, never you. If the business does not pay a lender, the lender can still collect those amounts from you under your guarantee. In your agreement
Any other expenseDisclosed in writing, with who pays it.Before you incur it

The monitoring plan and its referral fee are open items with the monitoring service and our attorneys. We confirm both in writing before you enroll.

Payments

The business sets up autopay from its own operating account, funded ahead of each due date. The business is responsible under our agreement for making payments. It may fail to pay. Your obligations to the lender remain enforceable under the lender's documents. Our agreement never asks you to pay the business's accounts from your personal funds.

The lender can hold you personally liable for the debt.

Your liability depends on each lender's documents. A personal guarantee can expose you to the full balance you guarantee, plus interest, fees and collection costs. You keep your own login at each issuer. The portal shows available account and payment information, with its last update time. Confirm payment status directly with each issuer; portal information may be delayed or incomplete. The issuer's records control.

Use of funds and how money moves

Approved credit is used only within each issuer's rules, for business purposes set in the agreement. The use of funds is stated truthfully on every application.

  1. 01

    Cards

Real business purchases of the borrower, paid by the business.

  2. 02

Lines of credit and term loans

Draws go to the business's operating account under the lender's own terms, each logged with its purpose.

  3. 03

    Investments and real-estate loans

A documented, approved investment, or a loan with a written note and deed of trust, each reviewed for the lending rules that apply.

Allowed, as set in the schedule

  • Business purchases on the cards, within each issuer's terms.
  • Cash only from lines of credit or term loans drawn under their own terms.
  • Real-estate loans with a written note and deed of trust, each reviewed for licensing, interest-rate and other lending requirements.
  • Company investments, each documented and approved, never in a company you own.

Never

  • Card cash advances or manufactured spending used to move money into investments or loans.
  • Disguised cash transfers: gift cards, money orders, prepaid loads, person-to-person transfers, or running cards through a merchant account owned by BCP, you or an affiliate.
  • Any use outside the schedule without your written consent.
  • New applications or draws while any account is past due.

We make no promises about investment results, and your fee does not depend on them.

Safeguards and their limits

Set in your agreement. Autopay can fail. A reserve can run out. An indemnity is only as good as the company behind it. None of these changes what you owe a lender.

  • Reserve account

Funded by BCP from its own money before your first application, never by drawing on the new credit, and held in the business's name under a control agreement that lets you direct payments if one is missed. It covers a set number of months of estimated payments, not the full debt, and it can be depleted.

  • Indemnity

BCP's holding companies agree in writing to repay what you pay a lender because of the business's debt. It is a claim you can make against those companies, not a release from the lender. If they cannot pay, you still owe the lender.

  • Collateral and caps

A security interest for you in the real-estate notes financed with your credit, where the agreement provides it, and a cap on the total you guarantee. Collateral can lose value, and enforcing it takes time and money.

  • Autopay and payment alerts

They lower the chance of a missed payment. Autopay can fail, the operating account can be short, and portal data can be delayed or incomplete.

Many lender guarantees ask the guarantor to give up certain defenses against the lender. Your right to be repaid by BCP's companies is separate, is written into our agreement with you, and is only as strong as those companies.

Reporting

  • Partner portal

Available account information with its last update time: limit, balance, statement, due date, minimum, scheduled, pending and posted payments, autopay status, reserve and fee schedule. It can be delayed or incomplete.

  • Your own issuer login

Full access at each issuer, with your own login. We never hold it, and the issuer's records control.

  • Monthly statement package

Statements, payments and reserve activity, by the 5th business day of each month.

  • Quarterly review

A next round happens only if every account is current and the reserve is full.

If a payment is missed

The plan is written down before you start. Planned terms, set in your agreement.

Planned escalation path

  1. An alert goes to you and our team within 24 hours of a missed or returned payment.
  2. Support works the issue and tells you in writing what the reserve paid: hello@businesscreditpartners.com.
  3. If it is not resolved within 2 business days, or support does not reply, escalate to the program lead: hello@businesscreditpartners.com.
  4. At any point, contact the issuer directly with your own login. You never have to wait for us.

If something fails

Plans for the things that can go wrong, and what still stays true for you.

  • If BCP or its companies fail

You can direct the reserve under the control agreement, enforce any collateral and claim under the indemnity. None of these releases you from a lender. If they are not enough, you owe the lender the rest under your guarantee.

  • If an investment or loan fails

The business still owes every lender. Your fee does not depend on investment results, but collateral tied to a failed loan may be worth less, and if the business cannot pay, the lender can collect from you.

  • If the portal fails or data goes stale

Your own issuer logins, alerts and the monthly statement package still work. A stale connection is flagged with its last update time. Confirm status directly with each issuer.

  • If our team is unreachable

After 10 business days you can direct the reserve and require a payoff plan. Contact each issuer directly, and send written notice to stop new borrowing.

Exit, payoff and release

Planned exit

  • Each account is paid to zero and closed, or you are replaced as signer where the issuer allows it.
  • Some issuers keep the original signer liable until they approve a replacement, or for balances from before you left.
  • Your guarantee ends only when each lender confirms the release in writing, or the account is paid off and closed. Ask each lender for that confirmation.
  • BCP releases you from our agreement in writing and you resign as officer. Our release does not release you from a lender.
  • Every intro rate gets a payoff plan at least 60 days before it ends.

If you want out

  • Before you sign: you may withdraw at any time. After signing, cancellation depends on the agreement.
  • Give 60 days' notice. No new borrowing happens after notice.
  • BCP pays down and closes or replaces each account within 90 days, funded by the business or BCP.
  • Fee installments you have earned stay payable after you leave.
  • Leaving your officer role does not release a personal guarantee.
  • Written procedures cover death, disability, bankruptcy and divorce.

  2. 02

  4. 04

    Application control terms

  5. 05

    Data and portal terms

What we hold, who sees it, how long we keep it, and the limits of portal data.

  11. 11

    Dispute terms

How disagreements are resolved. There is no clause stopping you from speaking about your experience.

  12. 12

    Spousal acknowledgment, where it applies

For our agreement only, as a fit check. It is not a substitute for any spousal consent the law requires, and we never require a spouse to sign a lender's guarantee.

Separately, you sign each lender's own application and guarantee yourself. The lender can hold you personally liable for the debt. You may withdraw before entering an agreement. After signing, cancellation depends on that agreement. Leaving your officer role does not release a personal guarantee.
